As an 8-bit gfx designer, I can tell you it isn't completely 8-bit.
First you need to follow the '3 colors rule' from the NES Games and here are 5 colors at least.

"The rule of 3 colours" is really "the rule of 4 colours" Anyway... As rahr says there 5 colors here... And you canĀ“t use every color you want. 8-bits Mario games have a special pallete to use.

NOT fixed. Rahr is actually right. It is the three colors rule. Remove the red and you will be fine. Just to refresh your mind... Rahr's playable Yoshi is NOT 8-bit. BUT it's OK if it is SMB2 styled, but it is not, so make it SMB2.

That is only half right.
What pat says is true, there are 4 colors, but technically the 4th color is a transparent layer, therefore verifying that with this layer, the rule is 4 colors but without the layer, the rule is 3 colors.
